Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

                                                                            Ambulance Services Act

1(1) Section 1 of the Ambulance Services Act, chapter A-7.3 of the Acts of New Brunswick, 1990, is amended

       (a) by repealing the definition "hospital corporation";

       (b) in the English version in the definition "patient" by striking out the period at the end of the definition and substituting a semicolon;

       (c) by adding the following definition in alphabetical order:

"regional health authority" means a regional health authority established by the Regional Health Authorities Act.

1(2) Subsection 6(2) of the Act is amended by striking out "hospital corporation" and substituting "regional health authority".

1(3) Paragraph 7(2)(d) of the Act is amended by striking out "hospital corporations" and substituting "regional health authorities".

1(4) Section 9 of the Act is amended

       (a) in subsection (1) by striking out "hospital corporations" and substituting "regional health authorities";

       (b) in subsection (2) by striking out "hospital corporation" and substituting "regional health authority";

       (c) in subsection (3) by striking out "hospital corporation" and substituting "regional health authority".

1(5) Subsection 10(1) of the Act is amended by striking out "hospital corporation" and substituting "regional health authority".

1(6) Paragraph 15(b) is amended by striking out "hospital corporation" and substituting "regional health authority".

                                                                                  Archives Act

2(1) Section 1 of the Archives Act, chapter A-11.1 of the Acts of New Brunswick, 1977, is amended

       (a) by repealing the definition "hospital corporation";

       (b) by adding the following definition in alphabetical order:

"regional health authority" means a regional health authority as defined in the Regional Health Authorities Act;

2(2) Subsection 10(3) of the Act is amended

       (a) in subparagraph (g.2)(i) by striking out "hospital corporation" and substituting "regional health authority";

       (b) in paragraph (g.3) by striking out "board of trustees of a hospital corporation" and substituting "board of directors of a regional health authority".

                                                                               Auditor General Act

3 Section 1 of the Auditor General Act, chapter A-17.1 of the Acts of New Brunswick, 1981, is amended in the definition "agency of the Crown" by repealing paragraph (f)
and substituting the following:

       (f) regional health authorities as defined in the Regional Health Authorities Act,

                                                                                  Coroners Act

4 Subsection 31(3) of the Coroners Act, chapter C-23 of the Revised Statutes, 1973, is amended by striking out "hospital corporation as defined in the Hospital Act" and
substituting "regional health authority as defined in the Regional Health Authorities Act".

                                                                                  Evidence Act

5 Section 43.3 of the Evidence Act, chapter E-11 of the Revised Statutes, 1973, is amended

       (a) in subsection (1)

       (i) by repealing the definition "hospital corporation";

       (ii) by adding the following definition in alphabetical order:

"regional health authority" means a regional health authority as defined in the Regional Health Authorities Act;

       (b) in subsection (2)

       (i) in paragraph (a) by striking out "hospital corporation" and substituting "regional health authority";

       (ii) in paragraph (b) by striking out "hospital corporation" wherever it appears and substituting "regional health authority";

       (iii) in subparagraph (c)(i) by striking out "hospital corporation" and substituting "regional health authority";

       (c) in paragraph (3)(a) by striking out "hospital corporations as required by the Hospital Act or the regulations" and substituting "regional health authorities as
       required by the Hospital Act or the Regional Health Authorities Act or the regulations under those Acts".

                                                                               Family Services Act

6(1) Subsection 11.1(4) of the Family Services Act, chapter F-2.2 of the Acts of New Brunswick, 1980, is amended

       (a) in paragraph (b) by striking out "hospital corporation as defined in the Hospital Act" and substituting "regional health authority as defined in the Regional Health
       Authorities Act";

       (b) in paragraph (c) by striking out "hospital corporation" and substituting "regional health authority".

6(2) Subparagraph 37(1)(b)(iv) of the Act is amended by striking out "hospital corporation as defined in the Hospital Act" and substituting "regional health authority as
defined in the Regional Health Authorities Act".

                                                                                    Health Act

7 Subsection 6(4) of the Health Act, chapter H-2 of the Revised Statutes, 1973, is amended

       (a) in paragraph (c)

       (i) in subparagraph (i) by striking out "hospital corporations as defined in the Hospital Act" and substituting "regional health authorities as defined in the Regional
       Health Authorities Act";

       (ii) in subparagraph (ii) by striking out "hospital corporations as defined in the Hospital Act" and substituting "regional health authorities as defined in the
       Regional Health Authorities Act";

       (b) in paragraph (d) by striking out "hospital corporations as defined in the Hospital Act" and substituting "regional health authorities as defined in the Regional
       Health Authorities Act".

                                                                               Health Services Act

8 Section 8.1 of the Health Services Act, chapter H-3 of the Revised Statutes, 1973, is amended in the portion following paragraph (b) by striking out "hospital corporation
as defined in the Hospital Act" and substituting "regional health authority as defined in the Regional Health Authorities Act".

                                                                                  Hospital Act

9(1) Section 1 of the Hospital Act, chapter H-6.1 of the Acts of New Brunswick, 1992, is amended

       (a) in the definition "admission" by striking out "and the admission of a patient for extra-mural services";

       (b) by repealing the definition "extra-mural services";

       (c) by repealing the definition "hospital corporation";

       (d) by repealing the definition "hospital services";

       (e) in the definition "patient"

       (i) by striking out "hospital corporation" and substituting "regional health authority";

       (ii) in the English version by striking out the period at the end of the definition and substituting a semicolon;

       (f) by adding the following definition in alphabetical order:

"regional health authority" means a regional health authority as established under the Regional Health Authorities Act.

9(2) Section 10 of the Act is repealed.

9(3) Section 11 of the Act is repealed.

9(4) Section 12 of the Act is repealed.

9(5) Section 13 of the Act is repealed.

9(6) Section 14 of the Act is repealed.

9(7) Section 15 of the Act is repealed.

9(8) Section 15.1 of the Act is amended

       (a) in subsection (1) by striking out "hospital corporation" and substituting "regional health authority";

       (b) in subsection (5) by striking out "hospital corporations" and substituting "regional health authorities".

9(9) Section 16 of the Act is amended

       (a) by repealing subsection (1) and substituting the following:

16(1) Notwithstanding any other Act of the Legislature, or any articles of incorporation or letters patent, no person other than a regional health authority shall establish,
operate or maintain a hospital facility in the Province.

       (b) in subsection (2) by striking out "hospital corporation" and substituting "regional health authority";

       (c) in subsection (3) by striking out "hospital corporation" and substituting "regional health authority";

       (d) by repealing subsection (4);

       (e) by repealing subsection (5).

9(10) Section 17 of the Act is repealed.

9(11) Section 18 of the Act is repealed.

9(12) Section 19 of the Act is repealed.

9(13) Section 20 of the Act is repealed and the following is substituted:

20(1) Subject to subsections (2) and (3), a regional health authority shall not refuse to admit a person as a patient to a hospital facility operated by it, if the person, from
sickness, disease, injury or other cause, requires hospital services.

20(2) A regional health authority may refuse to admit a person as a patient if the person's life is not endangered by the refusal and if, in the opinion of the chief executive
officer of the regional health authority, or of the senior administrative officer of a hospital facility operated or maintained by the regional health authority, based on competent
medical advice,

       (a) the condition of the person is such that the person does not require hospital services,

       (b) the regional health authority or the hospital facility does not provide the hospital services required,

       (c) the services of the regional health authority or hospital facility and condition of the person are such that the hospital services required could be more effectively
       provided at a later date, or

       (d) the condition of the person is such that the services required could be provided as effectively without admission.

20(3) A regional health authority may refuse to admit a person as a patient if the person's life is not endangered by the refusal and if the hospital services required by the
person are not entitled services under the Hospital Services Act.

9(14) Section 21 of the Act is amended by striking out "hospital corporation" wherever it appears and substituting "regional health authority".

9(15) Section 22 of the Act is repealed.

9(16) Section 23 of the Act is repealed.

9(17) Section 24 of the Act is amended

       (a) in subsection (1) by striking out "hospital corporation" and substituting "regional health authority";

       (b) by repealing subsection (2).

9(18) Section 25 of the Act is repealed.

9(19) Section 26 of the Act is amended

       (a) by repealing subsection (1);

       (b) by repealing subsection (2);

       (c) by repealing subsection (3);

       (d) by repealing subsection (4);

       (e) by repealing subsection (5);

       (f) by repealing subsection (6).

9(20) Section 27 of the Act is repealed.

9(21) Section 28 of the Act is repealed.

9(22) Section 29 of the Act is repealed.

9(23) Paragraph 30(1)(a) of the Act is amended by striking out "hospital corporation" and substituting "regional health authority".

9(24) Section 34 of the Act is amended

       (a) by repealing subsection (3);

       (b) by repealing subsection (6).

9(25) Section 35 of the Act is amended

       (a) in subsection (1)

       (i) by repealing paragraphs (a) to (i), inclusive;

       (ii) in paragraph (i.7) by striking out "hospital corporation" wherever it appears and substituting "regional health authority";

       (iii) by repealing paragraph (j);

       (iv) in paragraph (n) by striking out "hospital corporations and";

       (v) by repealing paragraphs (t), (u), (v) and (w);

       (vi) in paragraph (x) by striking out "board of trustees of a hospital corporation to include in the bylaws of the hospital corporation" and substituting "board of
       directors of a regional health authority to include in the bylaws of the regional health authority";

       (vii) in paragraph (aa) by striking out "hospital corporation" and substituting "regional health authority";

       (b) in subsection (2)

       (i) in paragraph (a) by striking out "hospital corporations" and substituting "regional health authorities";

       (ii) in paragraph (b) by striking out "hospital corporations or".

9(26) Section 36 of the Act is repealed.

9(27) Section 37 of the Act is repealed.

10(1) Section 1 of An Act to Amend the Hospital Act, chapter 62 of the Acts of New Brunswick, 1993, is amended

       (a) in the definition "patient" as enacted by paragraph 1(a) by striking out "hospital corporation" and substituting "regional health authority";

       (b) by repealing the definition "person other than a hospital corporation" as enacted by paragraph 1(b) and substituting the following:

"person other than a regional health authority" includes, but is not limited to, a body corporate established and controlled by a religious denomination;

10(2) Section 2 of the Act is amended in subsection 16(1) as enacted by section 2 by striking out "hospital corporation" and substituting "regional health authority".

10(3) Section 3 of the Act is amended in subsection 26(7) as enacted by section 3 by striking out "hospital corporation" and substituting "regional health authority".

10(4) Section 5 of the Act is amended

       (a) in subsection 32.1(1) as enacted by section 5 by striking out "hospital corporation" and substituting "regional health authority";

       (b) in subsection 32.1(2) as enacted by section 5 by striking out "hospital corporation" and substituting "regional health authority".

10(5) Section 8 of the Act is amended

       (a) by repealing paragraph (n) as enacted by subparagraph 8(a)(ii) and substituting the following:

       (n) respecting the classification and grading of hospital facilities established, operated or maintained by regional health authorities;

       (b) in paragraph (n.1) as enacted by subparagraph 8(a)(iii) by striking out "hospital corporations" and substituting "regional health authorities";

       (c) by repealing subsection 35(2) as enacted by paragraph 8(b) and substituting the following:

35(2) The Lieutenant-Governor in Council may declare, for such time or times as the Lieutenant-Governor in Council considers appropriate, all or any of the regulations to be in force with respect only

       (a) to any one or more regional health authorities or hospital facilities established, operated or maintained by regional health authorities, or

       (b) to any one or more classes of hospital facilities established, operated or maintained by regional health authorities.

       (d) in subsection 35(3) as enacted by paragraph 8(c) by striking out "hospital corporations" wherever it appears and substituting "regional health authorities".

10(6) Section 9 of the Act is repealed and the following is substituted:

11(1) The heading "ADVANCED LIFE SUPPORT SERVICES ACT" preceding section 1 of An Act Respecting the Hospital Act, chapter 78 of the Acts of New Brunswick, 1994, is repealed.

11(2) Section 1 of the Act is repealed.

11(3) Section 3 of the Act is repealed and the following is substituted:

3 Section 43.3 of the Evidence Act, chapter E-11 of the Revised Statutes, 1973, is amended

       (a) in subsection (2)

       (i) by repealing paragraph (a) and substituting the following:

       (a) providing any information as to any proceeding before a committee established by a regional health authority as defined in the Regional Health Authorities Act, or by a person who holds a licence issued under section 32.1
       of the Hospital Act, to conduct any study, research or program for the purpose of medical education or improvement in medical or hospital care or practice, and

       (ii) by repealing paragraph (b) and substituting the following:

       (b) producing any document made by a regional health authority or person referred to in paragraph (a) or by a committee established by the regional health authority or person, prepared exclusively for the purpose of being used
       in the course of, or arising out of, any study, research or program, the dominant purpose of which is medical education or improvement in medical or hospital care or practice.

       (b) by repealing paragraph (3)(a) and substituting the following:

       (a) records maintained by regional health authorities as defined in the Regional Health Authorities Act, or by persons who hold a licence issued under section 32.1 of the Hospital Act, as required by the Hospital Act or the
       Regional Health Authorities Act or the regulations under those Acts, or

11(4) Section 4 of the Act is repealed and the following is substituted:

4 Section 40 of the Family Services Act, chapter F-2.2 of the Acts of New Brunswick, 1980, is repealed and the following is substituted:

40(1) Where medical evidence at the hearing discloses that a neglected adult or an abused adult requires treatment in a hospital facility the court may include in an order made under subsection 39(1) an order for hospitalization in a
hospital facility operated and maintained by a regional health authority as defined in the Regional Health Authorities Act.

40(2) At any time pending the final determination of an application for an order under subsection 39(1), the court may order the removal of the person in respect of whom the order is sought to a hospital facility operated and maintained
by a regional health authority as defined in the Regional Health Authorities Act, or other place, without delay if a medical practitioner certifies that, in the medical practitioner's opinion, it is necessary to do so in the interests of the
person's health.

11(5) Section 5 of the Act is repealed and the following is substituted:

5(1) Section 9 of the Health Act, chapter H-2 of the Revised Statutes, 1973, is repealed and the following is substituted:

9 Subject to the approval of the Lieutenant-Governor in Council, the Minister or a person designated by the Minister may take possession of any land or building for use as a temporary or permanent hospital facility by a regional
health authority as defined in the Regional Health Authorities Act.

5(2) Subsection 19(1) of the Act is repealed and the following is substituted:

19(1) A medical health officer may enter into any house or premises for the purpose of making inquiry and examination with respect to the state of health of a person therein, and may cause any person therein found infected with a
contagious or infectious disease to be removed to a hospital facility operated and maintained by a regional health authority as defined in the Regional Health Authorities Act, or other proper place, but no such removal shall take place
unless the person can be removed without danger to life.

5(3) Subsection 26(8) of the Act is repealed and the following is substituted:

26(8) The Minister may direct the transfer of any person detained under this section to a hospital facility operated and maintained by a regional health authority as defined in the Regional Health Authorities Act, to a sanatorium, or to
any other place when the Minister considers the transfer to be necessary for the welfare of the patient.

11(6) Section 6 of the Act is repealed and the following is substituted:

6 Section 8.1 of the Health Services Act, chapter H-3 of the Revised Statutes, 1973, is repealed and the following is substituted:

8.1 Notwithstanding any other provision of this Act, the Minister may, for purposes of

       (a) controlling, reducing or discontinuing the inappropriate use of drugs provided as entitled services, or

       (b) controlling or preventing abuses of a health services plan as it relates to drugs,

communicate to a regional health authority as defined in the Regional Health Authorities Act, a person who holds a licence issued under section 32.1 of the Hospital Act, a medical doctor or a pharmacist, subject to any terms or
conditions the Minister may impose, any information furnished to the Minister under this Act or the regulations.

11(7) Section 8 of the Act is repealed and the following is substituted:

8 Section 4.1 of the Prescription Drug Payment Act, chapter P-15.01 of the Acts of New Brunswick, 1975, is repealed and the following is substituted:

4.1 Notwithstanding any other provision of this Act, the Minister may, for purposes of

       (a) controlling, reducing or discontinuing the inappropriate use of entitled services, or

       (b) controlling or preventing abuses of a programme established under this Act,

communicate to a regional health authority as defined in the Regional Health Authorities Act, a person who holds a licence issued under section 32.1 of the Hospital Act, a physician or a pharmacist, subject to any terms or conditions
the Minister may impose, any information obtained by or on behalf of the Minister under this Act.

11(8) Section 9 of the Act is repealed and the following is substituted:

9 Section 9 of the Venereal Disease Act, chapter V-2 of the Revised Statutes, 1973, is repealed and the following is substituted:

9 Whenever a person is admitted as a patient at a hospital facility to be treated for venereal disease, the regional health authority, as defined in the Regional Health Authorities Act, or the person who holds a licence issued under section
32.1 of the Hospital Act, as the case may be, who operates the hospital facility shall immediately forward to the Director a report on the case in the prescribed form.

                                                                                 Hospital Services Act

12(1) Section 1 of the Hospital Services Act, chapter H-9 of the Revised Statutes, 1973, is amended

       (a) by repealing the definition "hospital corporation";

       (b) by adding the following definition in alphabetical order:

"regional health authority" means a regional health authority as defined in the Regional Health Authorities Act;

12(2) Section 4 of the Act is amended

       (a) by repealing paragraph (e);

       (b) by repealing paragraph (f);

       (c) in paragraph (h) by striking out "hospital corporations" wherever it appears and substituting "regional health authorities";

       (d) in paragraph (i) by striking out "hospital corporations" and substituting "regional health authorities";

       (e) in paragraph (k) by striking out "medical practitioners" and "medical and other hospital corporation records" and substituting "medical practitioners and other health professionals" and "clinical and other regional
       health authority records" respectively;

       (f) in paragraph (k.1) by striking out "medical practitioners" and "medical and other records" and substituting "medical practitioners and other health professionals" and "clinical and other records" respectively;

       (g) by repealing paragraph (l).

12(3) Subsection 4.01(2) of the Act is amended

       (a) in the portion preceding paragraph (a) by striking out "hospital corporation" and substituting "regional health authority";

       (b) in the portion following paragraph (c) by striking out "hospital corporation" and substituting "regional health authority".

12(4) Subsection 9(1) of the Act is amended

       (a) in paragraph (b.2) by striking out "hospital corporation" and substituting "regional health authority";

       (b) in paragraph (d) by striking out "hospital corporations" and substituting "regional health authorities";

       (c) in paragraph (e) by striking out "hospital corporations" and substituting "regional health authorities".

                                                                              Medical Services Payment Act

13(1) Section 1 of the Medical Services Payment Act, chapter M-7 of the Revised Statutes, 1973, is amended in the definition "private hospital facility" by striking out "hospital corporation as defined in the Hospital Act"
and substituting "regional health authority as defined in the Regional Health Authorities Act".

13(2) Section 2.5 of the Act is amended by striking out "hospital corporation under the Hospital Act" and substituting "regional health authority under the Regional Health Authorities Act".

                                                                              Mental Health Services Act

14(1) Section 1 of the Mental Health Services Act, chapter M-10.2 of the Acts of New Brunswick, 1997, is amended

       (a) by repealing the definition "hospital corporation";

       (b) in the English version in the definition "Minister" by striking out the period at the end of the definition and substituting a semicolon;

       (c) by adding the following definition in alphabetical order:

"regional health authority" means a regional health authority as defined in the Regional Health Authorities Act.

14(2) Section 2 of the Act is amended

       (a) in paragraph (g) by striking out "hospital corporation" and substituting "regional health authority";

       (b) in paragraph (h) by striking out "hospital corporation" and substituting "regional health authority".

14(3) Section 3 of the Act is amended

       (a) in subsection (1) by striking out "hospital corporation" and substituting "regional health authority";

       (b) in subsection (2)

       (i) in paragraph (a) by striking out "hospital corporation" and substituting "regional health authority";

       (ii) in paragraph (b) by striking out "hospital corporation" and substituting "regional health authority";

15 Section 16 of the Nursing Homes Act, chapter N-11 of the Acts of New Brunswick, 1982, is amended by striking out "hospital corporation as defined in the Hospital Act" and "or hospital corporation" and substituting
"regional health authority as defined in the Regional Health Authorities Act" and "or regional health authority" respectively.

                                                                                  Ombudsman Act

16 Section 6 of Schedule A of the Ombudsman Act, chapter O-5 of the Revised Statutes, 1973, is repealed and the following is substituted:

17 Section 4.1 of the Prescription Drug Payment Act, chapter P-15.01 of the Acts of New Brunswick, 1975, is amended in the portion following paragraph (b) by striking out "hospital corporation as defined in the Hospital
Act" and substituting "regional health authority as defined in the Regional Health Authorities Act".

                                                                                 Provincial Loans Act

18 Section 2 of the Provincial Loans Act, chapter P-22 of the Revised Statutes, 1973, is amended by

       (a) repealing paragraph (1)(c) and substituting the following:

       (c) such sums of money as are required by a regional health authority, as defined in the Regional Health Authorities Act, for temporary purposes if the regional health authority is authorized to borrow for temporary purposes.

       (b) in subsection (6) by striking out "hospital corporation" wherever it appears and substituting "regional health authority".

                                                                                  Public Health Act

19(1) Section 1 of the Public Health Act, chapter P-22.4 of the Acts of New Brunswick, 1998, is amended

       (a) by repealing the definition "hospital corporation";

       (b) by adding the following definition in alphabetical order:

"regional health authority" means a regional health authority as defined in the Regional Health Authorities Act;

19(2) Section 30 of the Act is amended in the portion preceding paragraph (a) by striking out "hospital corporation" and "the corporation" and substituting "regional health authority" and "the regional health authority"
respectively.

19(3) Section 37 of the Act is amended by striking out "hospital corporation" wherever it appears and substituting "regional health authority".

                                                                           Public Service Superannuation Act

20 Schedule A of New Brunswick Regulation 84-105 under the Public Service Superannuation Act is amended by striking out "those hospital corporations, other corporations" and substituting "those regional health
authorities, other corporations".

                                                                         Social Services and Education Tax Act

21 Paragraph 11(xx) of the Social Services and Education Tax Act, chapter S-10 of the Revised Statutes, 1973, is amended by striking out "hospital corporation" and substituting "regional health authority".

                                                                                 Venereal Disease Act

22 Section 9 of the Venereal Disease Act, chapter V-2 of the Revised Statutes, 1973, is amended by striking out "hospital corporation as defined in the Hospital Act" and "the hospital corporation" and substituting "regional
