Amendment :Section 2

In subsection 5.2(2) of the French version by adding “le” before “paragraphe”.

Section 9 Paragraph (c)

In paragraph 16(2.1)a) of the French version by striking out “au moins quinze jours avant” and substituting “ pas plus de quinze jours avant”.

Section 36

In paragraph 45(2)b) of the French version by striking out “établissement” and substituting “l’établissement”.

By striking out subparagraph 45(3)a)(iv) of the French version and substituting the following:

(iv) si à la veille de la dissolution de l'Assemblée législative qui a précédé l'élection il y était député, l'endroit dans Fredericton ou ses environs où il résidait pour remplir ses fonctions de député;

Section 43 Paragraph (a) Subparagraph (iii)

In paragraph d) of the French version by striking out “scrutin ordinaire” and substituting “scrutin”.

Section 71

In subsection 79(1) of the French version in the portion preceding paragraph a) by adding “à la liste électorale” after “qui suit”.

Section 94

In paragaph 87.61(4)b) of the French version by adding “ordinairement” after “réside”.

Section 103

In subsection 93(6) of the French version in the portion preceding paragraph a) by striking out “directeur général des élections” and substituting “directeur du scrutin”.

Section 17

By striking out the section and substituting the following:

17 Paragraph 20.9(1)(a) of the Act is amended by striking out “six months” and substituting “40 days”.

Section 35

By striking out paragraph (b) and substituting the following:

(b) by repealing paragraph (c) and substituting the following:

(c) has been or will have been ordinarily resident in the Province for 40 days immediately preceding the date of the election, and

By striking out paragraph (a).

Section 2

In subsection 5.2(1) by striking out “before a scheduled general election is held and on or before nomination day for any other election” and substituting “before the writ is issued for an election”.

Section 2


(a) by adding after subsection 5.1(1) the following:

5.1(1.1) A directive may only be issued under subsection (1) if it has been approved by the advisory committee.

(b) by striking out subsection 5.1(3) and substituting the following:

5.1(3) A by-election shall not be held in accordance with a directive under this section unless the Chief Electoral Officer has done the following at least 60 days before the writ is issued for the by-election:

(a) provided a copy of the directive to each registered political party; and
(b) published the directive on the Elections New Brunswick website.

Section 44 Paragraph (a)


In subsection 59(1) by striking out “one or more polling stations” and substituting “ a polling station”.

Section 94

(a) by striking out subsection 87.51(1) and substituting the following:

87.51(1) Subject to subsections (2) and (3), the returning officer shall appoint 4 or more special voting officers in the following manner:

(a) two or more officers from the list of nominees filed under subsection 61(5) by the registered political party that was the governing party immediately before the commencement of the election period; and

(b) two or more officers from the list of nominees filed under subsection 61(5) by the registered political party that was the party of the official opposition immediately before the commencement of the election period.

(b) in paragraph 87.51(2)(a) by striking out “2” and substituting “4”;

(c) by adding after subsection 87.51(4) the following:

87.51(5) When the vote of an elector is taken by special voting officers outside an office of the returning officer, it shall be taken by 2 special voting officers.

87.51(6) When it is possible to do so, the returning officer shall ensure the following:

(a) that 2 special voting officers are available at each office of the returning officer during its normal operating hours, one of whom shall be an appointee from the list referred to in paragraph (1)(a) and one of whom shall be an appointee from the list referred to in paragraph (1)(b); and

(b) when the vote of an elector is taken in accordance with subsection (5), that one of the special voting officers is an appointee from the list referred to in paragraph (1)(a) and one is an appointee from the list referred to in paragraph (1)(b).
