Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:



Definitions

1                           In this Act,



"Committee" means the committee established in section 2. (ComitÚ)



"Minister" means the Minister of Education. (ministre)



"objectives" means the objectives established pursuant to section 4 for the enhancement of safety and the reduction of aggressive behaviour and bullying in schools. (objectifs)



Establishment of Committee

2                           A body for study and consultation is established under the name "Committee for Safe Schools" in English and "le ComitÚ pour des Úcoles sÚcuritaires" in French.



Duties of the Committee

3                           The Committee shall



(a)               provide advice and counsel to the Minister on achieving the objectives; and



(b)               report to the Legislative Assembly on the progress made towards the objectives and the additional steps required to ensure their attainment.



Objectives

4                           The Minister shall consult with the Committee in order to further the attainment of the following objectives on or before the lapse date established pursuant to section 10:



(a)               expanding upon a positive school environment policy by engaging in broad consultations with stakeholders to develop a more extensive policy to respond to problems of school violence and bullying;



(b)               developing a plan of proactive strategies that respond to aggressive behaviour and bullying on motor vehicles operated for the conveyance of pupils;



(c)               establishing a mechanism for sharing between districts best-practices for combating aggressive behaviour and bullying;



(d)               developing provincial protocols for security of school buildings and properties.



Committee Report

5(1)                   The Committee shall report to the Legislative Assembly each calendar year no later than the thirty-first day of December, by filing a report with the Speaker of the Legislative Assembly.



5(2)                   The report of the Committee shall contain



(a)               a progress report on the attainment of the objectives;



(b)               recommendations for making further progress on the objectives, including the adequacy of current levels of funding; and



(c)               any further information the Committee shall see fit in its discretion.



5(3)                   The Minister may, by regulation, impose additional requirements upon the report of the Committee.



5(4)                   The Minister shall, within ninety days of receipt of the Committee's report by the Office of the Speaker of the Legislative Assembly, lay before the Legislative Assembly a response to any recommendations for future steps made by the Committee.



Composition of Committee

6(1)                   The Committee shall consist of up to nine members appointed by the Minister.



6(2)                   The Minister shall appoint a Chairperson.



6(3)                   The Minister shall ensure that at least three members of the Committee are school teachers employed within the Province of New Brunswick.



6(4)                   The Minister shall ensure that one member of the Committee is a representative of the Department of Public Safety.



6(5)                   The Minister shall ensure representation from the Anglophone and Francophone education systems when making appointments to the Committee.



6(6)                   The Minister shall, in making appointments under this section, consult with the associations representing teachers, teacher assistants, school intervention workers, library personnel, administrative support staff, bus drivers, custodial staff and food services staff, in negotiations under the Public Service Labour Relations Act.



Reappointment or replacement of members

7(1)                   The members of the Committee shall continue to serve, notwithstanding the expiry of their term, until notice is given to the Minister.



7(2)                   The Minister shall fill any vacancy upon the Committee as required.



Compensation

8                           The Minister may, by regulation, establish compensation to be paid to members of the Committee.



Consequential amendment

9                           Subsection 57(1) of the Education Act, chapter E-1.12 of the Acts of New Brunswick, 1997, is hereby amended by adding after paragraph (fff) the following:



(fff.1)       respecting a positive school environment policy;



(fff.2)       respecting provincial protocols for security of school buildings and property;



(fff.3)       respecting safety protocols to respond to aggressive behaviour and bullying on motor vehicles operated for the conveyance of pupils;



Expiration

10                        Sections 1 through 8, inclusively, shall expire two years after this Act has been proclaimed.



Commencement

11                        This Act or any provision of it comes into force on a day or days to be fixed by proclamation.
