Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:



Statement of Purpose

1                           The intent, purpose, and object of this Act is to provide the same protection under the law to the residents of retirement homes as accorded to residents of other residential home care facilities in the Province.   



Consequential Amendments

2(1)                   The Residential Tenancies Act, chapter R-10.2 of the Acts of New Brunswick, 1975, is amended



(a)               in subsection 1(1) of the French version of the definition parc de maisons mobiles by striking out the period at the end of the definition and substituting a semicolon;



(b)               by adding in subsection 1(1) the following definition in alphabetical order:



"retirement home" means a residential facility operated for profit that caters to the needs of retired persons but does not include an institution defined under the Nursing Homes Act, Mental Health Act, the Hospital Services Act, or the Hospital Act;



(c)               by adding the following after section 3.1:



3.2(1)             A landlord of a retirement home is subject to investigation by the Minister of Family and Community Services where a complaint is made about any breach of standards laid out in sections 3 and 3.1.



3.2(2)             Where an investigation is conducted under subsection (1), the Minister of Family and Community Services shall have all the powers conferred under the Family Services Act.



2(2)                   The Family Services Act, chapter F-2.2 of the Acts of    New Brunswick, 1980, is amended



(a)               by adding in section 1 the following definition in alphabetical order:



"retirement home" means a residential facility operated for profit that caters to the needs of retired persons but does not include an institution defined under the Nursing Homes Act, Mental Health Act, the Hospital Services Act, or the Hospital Act;



(b)               by adding the following after section 34:



34.1(1)          Where a complaint is received by the Minister in regards to a breach of sections 3 and 3.1 of The Residential Tenancies Act, the Minister shall assign an officer to investigate.



34.1(2)          Where the officer, assigned under subsection (1), determines that a landlord of a retirement home is in violation of The Residential Tenancies Act or finds that a resident has been abused or neglected or reasonably suspects that a resident is in danger of being abused or neglected, the officer shall report to the Minister.



34.1(3)          Where appropriate, the Minister may forward the results of any investigation to the rentalsman or take action under section 35 of the Act.
