Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows: 1 The Shortline Railways Act, chapter S-8.1 of the Acts of New Brunswick, 1994, is amended by adding after section 8 the following: Exemption from regulations 8.1(1) Subject to subsection (2), the Minister may, on any terms and conditions that the Minister considers necessary, exempt a railway company, shortline railway or other person from the application of a regulation made under section 8 if, in the opinion of the Minister, the exemption is in the public interest and is not likely to threaten safety. 8.1(2) Where a regulation made under section 8 relates to the sounding of bells and whistles at a railway crossing, the Minister may, on any terms and conditions that the Minister considers necessary, exempt a railway company, shortline railway or other person from the application of the regulation if gates and protective devices of the flashing light type are in place.
