Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:



1                           Section 1 of An Act to Amend the Motor Vehicle Act, chapter 30 of the Acts of New Brunswick, 2001, is amended by repealing the definition "school bus" as enacted by section 1 and substituting the following:



"school bus" means, unless otherwise indicated, a bus owned by a public or governmental agency and operated for the transportation of children to or from school, or a   bus owned by a person other than a public or governmental agency and operated under contract with a public or governmental agency for the transportation of children to or from school, but does not include a municipal transit bus;



2                           Section 2 of the Act is amended in subsection 83(4) as enacted by section 2 by striking out "Pupil Conveyance and Lodging Regulation" and substituting "Pupil Transportation Regulation".



3                           Paragraph 4(a) of the Act is amended in subsection 188(0.1) as enacted by paragraph 4(a) by striking out "paragraph 205(1)(c)" and substituting "paragraph 205(1)(b)".



4                           Section 5 of the Act is amended by repealing subsection 205(1) as enacted by section 5 and substituting the following:



205(1)            The Lieutenant-Governor in Council, on the recommendation of the Minister, may make regulations



(a)               respecting the operation, the colour, the markings and other design features and the equipment of a school vehicle, as defined in the Pupil Transportation Regulation - Education Act, that is conveying or is intended to convey pupils, when owned and operated by any school district or privately owned and operated under contract with any school district in the Province;



(b)               respecting the identification, the operation, the colour, the markings and other design features and the equipment of a school bus;



(c)                establishing prohibitions in relation to



(i)         the operation, the colour, the markings and other design features and the equipment of a school vehicle referred to in paragraph (a), and



(ii)       the identification, the operation, the colour, the markings and other design features and the equipment of a school bus;



(d)               prohibiting the operation of any vehicle, other than a school bus, having a colour, markings or other design features or equipment so similar to that of a school bus that the public may be misled.



5                           This Act or any provision of it comes into force on a day or days to be fixed by proclamation.



EXPLANATORY NOTES



Section 1



This amendment repeals and replaces the definition "school bus" in section 1 of the Motor Vehicle Act. The definition    "school bus" as enacted by section 1 of An Act to Amend the Motor Vehicle Act is as follows:



"school bus" means, unless otherwise indicated, every bus owned by a public or governmental agency and operated for the transportation of children to or from school, or privately owned and operated under contract with a public or governmental agency for the transportation of children to or from school, but does not include



(a)               a municipal transit bus, or



(b)               a bus privately owned and operated under contract with a public or governmental agency for the transportation of children to or from school, at any time when the bus is not being used for that purpose;



Section 2



A correction is made in subsection 83(4) of the Motor Vehicle Act as enacted by section 2 of An Act to Amend the Motor Vehicle Act.



Section 3



This amendment is consequential to the amendment made in section 4 of this Amending Act.



Section 4



This amendment repeals and replaces subsection 205(1) of the Motor Vehicle Act. Subsection 205(1) as enacted by section 5 of An Act to Amend the Motor Vehicle Act is as follows:



205(1)            The Lieutenant-Governor in Council on the recommendation of the Minister may make regulations not inconsistent with this Act



(a)               respecting the operation of, the colour, markings and other design features of and the equipment of, mounted in or on or used by every school vehicle, as defined in the Pupil Conveyance and Lodging Regulation - Education Act, that is conveying or is intended to convey pupils, when owned and operated by any school district or privately owned and operated under contract with any school district in the Province;



(b)               establishing prohibitions in relation to regulations made under paragraph (a);



(c)                respecting the identification of, the operation of, the colour, markings and other design features of and the equipment of, mounted in or on or used by school buses.
