Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:



1                           Subsection 2(2) of the Assessment and Planning Appeal Board Act, chapter A-14.3 of the Acts of New Brunswick, 2001, is repealed and the following is substituted:



2(2)                   The Lieutenant-Governor in Council may appoint a maximum of three Vice-Chairpersons to the Board



(a)               none of whom shall be members of the Board appointed under paragraph (1)(b), and



(b)               each of whom shall be a barrister and solicitor who has been a member in good standing of the Law Society of New Brunswick for at least five years immediately preceding the date of appointment.



EXPLANATORY NOTE



Section 1



The existing provision is as follows:



2(2)                   The Lieutenant-Governor in Council may appoint one or two Vice-Chairpersons to the Board



(a)               neither of whom shall be a member of the Board appointed under paragraph (1)(b), and



(b)               one of whom shall be a barrister and solicitor who has been a member in good standing of the Law Society of New Brunswick for at least five years immediately preceding the date of appointment.
