Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:



1                           Section 5 of the Beaverbrook Art Gallery Act, chapter B-1 of the Revised Statutes, 1973, is amended



(a)               by repealing subsection (5) and substituting the following:



5(5)                   The Board of Governors shall elect from its members a Chair.



(b)               by adding after subsection (5) the following:



5(6)                   The term of office of the Chair of the Board of Governors shall be for one year, or until his or her term as Governor expires, whichever occurs first.



5(7)                   A Governor appointed under subsection (2) may be removed for cause by the Lieutenant-Governor in Council.



Transitional provisions

2(1)                   Any selection of a person as Chairman or acting Chairman of the Board of Governors of The Beaverbrook Art Gallery is revoked.



2(2)                   No action, application or other proceeding lies or shall be instituted against the Minister responsible for the Culture and Sport Secretariat or the Crown in right of the Province as a result of the revocation under subsection (1).



EXPLANATORY NOTES



Section 1



(a)               The existing provision is as follows:



5(5)                   The Chairman of the Board of Governors shall be such member thereof as is selected by the Custodian or Custodians.



(b)               New provisions.
