Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:



1                           Section 5.4 of the Youth Assistance Act, chapter Y-2 of the Acts of New Brunswick, 1984, is amended by adding after subsection (1) the following:



5.4(1.1)         Notwithstanding any other section of this Act, the Minister shall not reduce, alter or amend, nor make any rule or criterion allowing the reduction, alteration or amendment, of any amount awarded to a qualifying student by reason of the income or assets of the qualifying student's parent, step-parent, guardian, spouse, common-law spouse or any other relative upon whom the qualifying student is considered to be dependent.



5.4(1.2)         Nothing in this section shall prevent the Minister from establishing any rule or criterion, or undertaking any decision, which is necessary to ensure compliance with rules or regulations attached to a federal government program aimed at improving access to post-secondary education, on the condition that the rule, criterion or decision is limited in scope to administering only the funds provided under the federal government program at issue.
