Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:



1                           Section 23 of the Regional Health Authorities Act, chapter R-5.05 of the Acts of New Brunswick 2002, is amended by adding after subsection 23(2) the following:



23(3)               When the closure of a facility is proposed by a regional health authority, affected citizens



(a)               shall be given sufficient notice and be fully informed of the process to be followed,



(b)               shall be provided with documents relevant to the proposed closure, including internal and external studies and any other documents used by the regional health authority in making its decision,



(c)                shall have adequate time to consider the information provided, seek advice and consult with experts, if they should wish to do so, and



(d)               shall have adequate time to prepare and make a presentation to the regional health authority and be heard impartially.



23(4)               If the regional health authority fails to adhere to the standards of procedural fairness prescribed by subsection (3), the Minister shall withhold approval for the proposed closure.
