Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:


1                           The Insurance Act, chapter I-12 of the Revised Statutes, 1973, is amended by adding after subsection 230(2) statutory condition 1(2) the following:


(3)                      A “material change in risk” does not include the age of a vehicle if the vehicle has a valid certificate of inspection under the Motor Vehicle Act.


2                           The Act is amended by adding after subsection 230(2) statutory condition 8 the following:


8.1                      No contract outside Facility Association coverage, shall be refused by an insurer solely on the grounds of the age of a vehicle if the vehicle has a valid certificate of inspection under the Motor Vehicle Act.


3                              Section 369.1 of the Act is amended by adding after paragraph (i) in the definition “unfair or deceptive acts or practices in the business of insurance” the following:


(j)                any practice wherein a motor vehicle insurance policy is refused to a vehicle, due to the age of the vehicle, that has a valid certificate of inspection under the Motor Vehicle Act.
