   WHEREAS the Constitution of Canada provides that the English linguistic community and the French linguistic community in New Brunswick have equality of status and
equal rights and privileges and confirms the role of the Legislature and Government of New Brunswick to preserve and promote such status, rights and privileges; and
   
   WHEREAS the Constitution of Canada provides that English and French are the official languages of New Brunswick and have equality of status and equal rights and
privileges as to their use in all institutions of government; and
   
   WHEREAS the Constitution of Canada provides that any member of the public in New Brunswick has the right to communicate with, and to receive available services from,
any office of an institution of government in English or French; and
   
   WHEREAS by virtue of An Act Recognizing the Equality of the Two Official Linguistic Communities in New Brunswick the Government must ensure protection of the
equality of status and equal rights and privileges of the official linguistic communities and take positive actions, in its proposed laws, in the allocation of public resources and in
its policies and programs, to promote the social development of the official linguistic communities;
   
   THEREFORE, Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

1               The Regional Health Authorities Act, chapter R-5.05 of the Acts of New Brunswick, 2002, is amended by adding after section 39 the following:

39.1(1)   English is the principal language of work and management within all facilities and for all services administered by regional health authorities in regions 1(South-East), 2
and 3.

39.1(2)   French is the principal language of work and management within all facilities and for all services administered by regional health authorities in regions 1 (Beauséjour), 4
and 6, except the city of Bathurst.

39.1(3)   English and French have equal status as languages of work and management in all other facilities and for all other services administered by a regional health authority.

39.1(4)   A regional health authority shall ensure that it is possible everywhere and at all times for any member of the public to communicate with the reception within their facilities
and receive available emergency services in either official language.

39.1(5)   Subject to subsection (6), any health care service in New Brunswick, including laboratories and auxiliary services, is administered and made available in English in at least
one of the facilities mentioned in subsection (1) and in French in at least one of the facilities mentioned in subsection (2).

39.1(6)   Where by reason of cost the Minister determines that a specialized health care service can only be offered in a single facility in the Province, the facility selected for such
purpose must be able to offer such service, and do so, entirely and at all times in both official languages.
