   Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

1                   Paragraph 10(6)a) of the French version of the Pesticides Control Act, chapter P-8 of the Revised Statutes, 1973, is amended by striking out “une ordonnance
rendue” and substituting “un arrêté pris ou ordre donné”.

2                   Paragraph 12(5)a) of the French version of the Act is amended by striking out “une ordonnance rendue” and substituting “un arrêté pris ou ordre donné”.

3                   Section 28 of the Act is amended

   (a)       in subsection (1) of the French version by striking out the portion following paragraph c) and substituting the following:

l’inspecteur peut ordonner à cette personne d’arrêter immédiatement cette utilisation, cet entreposage, ce transport, cette application ou ce débarras du pesticide ou du récipient à
pesticide ou l’usage de toute méthode à ces fins, soit en permanence ou pour une période de temps précisée dans l’ordre, et il peut de même imposer l’ordre à toute autre
personne qui est propriétaire ou qui a la charge, l’administration ou le contrôle du pesticide ou du récipient à pesticides ou qui a le contrôle ou la surveillance des actions de toute
personne à qui l’ordre est imposé.

   (b)       by repealing subsection (1.1);

   (c)       by repealing subsection (2) and substituting the following:

28(2)       The inspector shall immediately forward a copy of the order and the reasons for the order to the Chairman of the Board.

4                   The Act is amended by adding after section 28 the following:

28.1(1)   Except in the case of an emergency situation, an order made under this Act, including an amendment or revocation of an order, shall

   (a)       be in writing,
   
   (b)       include the reasons for the order, and
   
   (c)         be served upon each person to whom the order is directed.

28.1(2)   Where an order made pursuant to subsection 28(1) is made in an emergency situation, the contents of the order shall be put in writing and served upon each person to
whom the order was directed within forty-eight hours after the time when it was made, but a failure to comply with this subsection does not invalidate the order.

5                   Section 29 of the Act is amended

   (a)       in subsection (1) by striking out “within thirty days after receiving the reasons pursuant to subsection 28(2)” and substituting “within thirty days after the day on
   which the order was served”;

   (b)       by repealing subsection (5) of the French version and substituting the following:

29(5)       Lorsqu’il est interjeté appel d’un ordre donné en application de l’article 28, l’ordre est en vigueur jusqu’à ce qu’il soit révoqué ou changé conformément au paragraphe (4)
sauf si le Ministre sursoit par écrit à l’application de l’ordre en attendant la conclusion de l’appel.

6                   The Act is amended by adding after section 30 the following:

30.01       Proceedings with respect to an offence under this Act or the regulations may be instituted at any time within two years after the time when the subject matter of the
proceedings arose.

7                   Section 30.1 of the French version of the Act is amended

   (a)       in subsection (1) in the portion following paragraph b) by striking out “Directeur” wherever it appears and substituting “directeur”;

   (b)       in subsection (2) in the portion preceding paragraph a) by striking out “Directeur” and substituting “directeur”.

Consequential Amendments
8(1)            Subsection 33(1) of the French version of New Brunswick Regulation 96-126 under the Pesticides Control Act is repealed and the following is substituted:

33(1)       L’ordre d’un inspecteur en vertu du paragraphe 28(1) de la Loi doit être donné au moyen de la formule 1.

8(2)            Form 1 of the Regulation is amended by repealing the heading “ORDONNANCE” in the French version and substituting the following:

                                                                                     ORDRE

8(3)            Form 2 of the Regulation is amended in the French version

   (a)       by striking out “de l’ordonnance ci-jointe. (Joindre une copie de l’ordonnance.)” and substituting “de l’ordre ci-joint. (Joindre une copie de l’ordre.)”;

   (b)       by striking out “l’ordonnance susvisée” and substituting “l’ordre susvisé”.

9                   This Act or any provision of it comes into force on a day or days to be fixed by proclamation.
